Terms of Use
These Terms of Use ("Terms") govern your access to and use of the Giftpose platform, including our mobile application and website. Please read them carefully. By accessing or using the Platform, you confirm that you are at least 18 years old and agree to be bound by these Terms.
1 Acceptance of Terms
By creating a Giftpose account or using any part of our Platform, you enter into a binding legal agreement with Giftpose Ltd ("Giftpose", "we", "our", or "us"). These Terms constitute the entire agreement between you and Giftpose with respect to your use of the Platform.
If you do not agree to these Terms, you must not use or access the Platform. Your continued use constitutes ongoing acceptance of the current Terms and any updates we may publish.
These Terms should be read together with our Privacy Policy, which explains how we handle your personal data.
2 Account Registration
To access core features of the Platform, you must register for a Giftpose account. When registering, you agree to:
- Provide accurate, current, and complete information during registration.
- Keep your account credentials confidential and not share them with others.
- Notify us immediately of any unauthorised use of your account.
- Maintain only one account per person (duplicate accounts may be removed).
You are responsible for all activity that occurs under your account. Giftpose will not be liable for any loss arising from your failure to maintain account security.
3 User Conduct
You agree to use the Platform only for lawful purposes and in a manner that does not infringe the rights of others or restrict their use and enjoyment of the Platform. The following behaviours are strictly prohibited:
Harassing, abusing, threatening, or causing distress to any other user.
Posting misleading, false, or fraudulent gift listings.
Transmitting spam, unsolicited communications, or malicious software.
Attempting to gain unauthorised access to our systems, networks, or databases.
Scraping, crawling, or using automated tools to extract Platform data without permission.
Impersonating any person or entity, or misrepresenting your affiliation with any person or entity.
Using the Platform for any commercial purpose without prior written consent from Giftpose.
Violation of these rules may result in immediate suspension or permanent termination of your account without notice.
4 Gifting Rules & Responsibilities
Giftpose is a free gifting platform. All items listed must be offered genuinely at no cost to the recipient. The following rules apply to all listings:
- Items must be legal to own and transfer in the country where the transaction occurs.
- Listings must accurately represent the item's condition (new, used, damaged, etc.).
- Items must not be counterfeit, stolen, or subject to recall.
- Prohibited items include weapons, controlled substances, hazardous materials, and adult content.
- Donors are solely responsible for ensuring items are safe and fit for gifting.
Giftpose acts as an intermediary only. We are not a party to any gifting transaction and accept no responsibility for the condition, safety, or legality of items exchanged between users.
5 Intellectual Property
The Giftpose name, logo, Platform design, software, and all associated content are the exclusive property of Giftpose Ltd and its licensors, protected by UK, EU, and international copyright, trademark, and other intellectual property laws.
When you post content on the Platform (photos, descriptions, messages), you grant Giftpose a worldwide, royalty-free, non-exclusive licence to use, reproduce, and display that content solely for the purpose of operating and promoting the Platform.
You retain ownership of content you create. Giftpose will never sell your content to third parties or use it in advertising without your explicit consent.
You may not reproduce, distribute, or create derivative works from Giftpose's intellectual property without prior written permission.
6 Disclaimers
The Platform is provided "as is" and "as available" without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Giftpose does not warrant that:
The Platform will be uninterrupted, timely, secure, or error-free at all times.
Any gifts or information obtained through the Platform will meet your expectations.
Defects in the Platform will be corrected on any specific timeline.
The Platform is free of viruses or other harmful components.
Any reliance you place on information from the Platform or other users is strictly at your own risk.
7 Limitation of Liability
To the fullest extent permitted by applicable law, Giftpose, its directors, employees, partners, agents, suppliers, or affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or other intangible losses, resulting from:
- Your access to, use of, or inability to access or use the Platform.
- Any conduct or content of any third party on the Platform, including without limitation any defamatory, offensive, or illegal conduct.
- Any content obtained from the Platform.
- Unauthorised access, use, or alteration of your transmissions or content.
- Any item exchanged between users, including property damage, personal injury, or economic loss.
Our total aggregate liability to you for any claim arising out of or in connection with these Terms shall not exceed the greater of £100 GBP or the amounts you have paid to Giftpose in the past 12 months.
8 Termination
Giftpose reserves the right to suspend or terminate your account at any time, with or without cause, including for violation of these Terms. You may close your account at any time through the in-app settings.
Upon termination, your right to use the Platform ceases immediately. Provisions of these Terms that by their nature should survive termination shall remain in effect, including intellectual property, disclaimers, and limitation of liability clauses.
9 Changes to Terms
We may revise these Terms at any time. When we do, we will update the "Last updated" date at the top of this page and, where material changes are made, notify you via email or in-app notification.
Your continued use of the Platform after changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the Platform.
